Estate Plan India

Estate Plan India:

If you are from India, here is some information to cheer you up. The Government of India has exempted wills made in India by Indian citizens from registration. So you can now make a will on plain paper and it will be valid.

You do need two witnesses who must state in the will that they have witnessed you signing the will, that is they must be present when you sign the will. The witnesses do not have to be told the contents of the will, nor do you need to give them a copy. Ideally the witnesses should be younger than you, and if possible, one of them should be your family doctor, so that he can certify in case of need that you were of sound mind when you made the will.

You may still register the will with the registrar of wills in your city or district court, but this is not essential. Where there is a chance of the will being contested, you may undertake this additional step.
